General terms and conditions of Rotho Sp. z o. o. 

1. validity

Our deliveries are made exclusively on the basis of these General Terms and Conditions (GTC). These T&Cs apply to the fulfillment of all orders placed in the online store operated by Rotho Sp. Z o. o. at www.pl.rotho.com (full details of the company as Data Controller can be found in section 10 of this document). The GCTCs in question are considered to be accepted by the customer in the course of Account registration or during the ordering process (for users who do not use the account function), by ticking the appropriate check-box confirming the customer's familiarization with the GCTCs and acceptance of their wording.

   Our online product offers are valid only when shown on the website and until stocks last. Images shown on the website are for reference only and are not binding.

2. coming to an agreement  

At www.pl.rotho.com, in order to make an order, the user can use the Account registration function, which also allows him/her to view the order archive, check the status of the current order, download a claim form and a return form, as well as an electronic invoice. In order to set up an Account, the user must read the terms and conditions and the rules for processing personal data (available at the link https://pl.rotho.com/pages/polityka-prywatnosci ) and confirm his/her consent to their provisions. The use of the electronic Account service on the site is not mandatory for effective order placement.

The user places an order by selecting the products of interest on the site and adding them to a virtual shopping cart, and then proceeds to the next step which is logging into the Account with his/her login and password given during registration, and in the absence of an account going straight on to the panel allowing the entry of contact information, address for shipping the order and the shipping method itself. In the case of a user making an order without registering/logging into the Account, he/she must additionally confirm by checking the check-box that he/she is familiar with the wording of the regulations and rules of personal data processing and agree to them.

You then proceed to the stage of selecting the form of payment and finalize the transaction in the selected transaction service. With the final confirmation of your order, you make us a binding offer to conclude a purchase agreement. You will then immediately receive an e-mail from us about the receipt of the order,. in the case of users using the Account service - this information will also be visible in the "Orders" tab. Acceptance of the order, and thus the coming to fruition of the contract, takes place at the time of delivery of the order confirmation with the reference number of the shipment (allowing its tracking), when the shipment took place. In the case of payment in advance, the coming to fruition of the contract is confirmed by sending our account details.

We reserve the right to make changes to prices and assortment at any time. Deliveries will be made only if the delivery address and billing address are in Poland. There is no minimum order value.

If, after confirming the order, it turns out that the delivery cannot be made in full because individual products are temporarily out of stock, we will inform the customer by e-mail about the new delivery date.

3 Prices and shipping costs

All prices include statutory sales tax or VAT.

When making an order, the User selects his/her preferred method of delivery from among the carriers provided by Rotho Sp. z o. o. - InPost Courier or InPost Parcel Machine, both services provided by InPost S.A. based in Cracow, 28 Wielicka Street, 30-552 Cracow, NIP: 6793087624, KRS: 0000536554

Shipping costs are paid in full by Rotho Ltd.

4 Delivery time

All deliveries are made within 6 business days. If we do not have the item in stock, we will immediately inform you of the new delivery date.

5 Payment terms

The user makes payment by paying in advance, choosing one of the available methods, through:

a. PayPal operated by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulavard Royal, L-2449 Luxembourg, Commercial Registry Number: R.C.S. Luxembourg B 118 349

b. electronic transfer supported by PeP (Polskie epłatności)

c. A credit card supported by PeP (Polish e-payments)

6. reservation of title

The delivered goods remain our property until full payment is made. The customer is obliged to cooperate in activities that are necessary to protect our property.

7. right of return and return instructions

If you are a consumer, i.e. an individual who makes a purchase for a purpose that cannot be attributed to your business or independent professional activity, you are entitled to the right of return described below. This does not apply to goods that have been specially made for you according to individual customer specifications.

Return instructions

You may return the received goods without stating a reason within 14 days after receipt by sending them back to Rotho Sp. Z o. o. address. - Władysława Grabskiego 2 Street, 75-209 Koszalin, using the return form available at www.pl.rotho.com/zwrot.

The complaint will be processed within 14 days.

Effects of return

In the event of a successful return, the services received by both parties are refunded. The return of products is effective only if the items are sent back to Rotho Ltd. in an undamaged condition that does not indicate that the products have been used other than merely to check their properties and functionality. Goods bearing traces of other use beyond the above two purposes are not returnable. "Checking the properties and functionality" means testing and trying out individual goods, which is possible and customary, for example, in a retail store. Rotho Ltd. shall consider the return and, in the case of a positive decision, refund the cost within 30 days of receiving the goods from the customer.

End of return instructions

8 Warranty and right to exchange

Statutory warranty provisions apply. In case of defects in delivery, please contact our Customer Service Department via email (customer.service@rotho.com) as soon as you notice them. Customer Service will send you a return label within two to three days. You can send the defective goods back to us without shipping costs. We will replace the defective goods. If this is impossible or unacceptable in individual cases, we will refund the purchase price already charged.

 

9 Jurisdiction of court, applicable law, salvatory clause 

If you are a merchant, a commercial company or a legal entity under private or public law or a public separate property, the local jurisdiction for any disputes arising out of or related to the contractual relationship is the registered office of Rotho Ltd. although we also have the right to hold you liable at your domicile or registered office or any other jurisdiction permitted by law. In the case of disputes arising from consumer contracts, you may bring an action at the residence or registered office of either party.

All legal relations between us and the customer shall be governed by Polish lawIf individual provisions of these T&Cs are unacceptable, the validity of the remaining clauses shall not be affected.
